St Peter’s Cathedral Booking Request Form Terms And Conditions
1. These terms and conditions apply to your request to book a St Peter’s Cathedral Space through the Cathedral’s Booking Request Form.
2. The hirer agrees to indemnify and to keep indemnified the Cathedral, its employees and/or agents against all actions, costs, claims, damages, charges and expenses whatsoever which may be brought or made or claimed against any of them arising out of or in relation to any activities under the hire agreement or arising out of breach of any condition attaching to the hire agreement.
3. By pressing ‘Submit’ you agree to these terms and conditions in connection with your request to book, and your use of, a St Peter’s Cathedral Space.
4. In these terms and conditions
4.1. Associates means any person (including without limitation to an employee, agent, contractor, external service provider, attendee or invitee) that accesses or uses the Venue in any way as a result of your booking.
4.2. Event means the purpose of the use of the Venue.
4.3. St Peter’s Cathedral Space means any land and buildings owned or operated by the St Peter’s Cathedral and includes without limitation the Cathedral building, Cynthia Poulton Hall, and John Dunn Room.
4.4. Venue means the location(s) that you request to book via the Cathedral’s Booking Request Form (https://recorder-bumblebee-jt9l.squarespace.com/booking-form).
5. By pressing ‘Submit’ you will submit a request to book a Venue. This request is does not constitute a booking.
6. The Cathedral will consider your request within a reasonable time of receipt, but is not obliged to accept your request at any time.
7. In submitting a request you warrant and represent that you are requesting a booking for a Venue for use by you, and not on behalf of any third party.
8. In considering your request, without limiting any other rights the Cathedral may have at law, the Cathedral may:
8.1. require you to provide any additional information that the Cathedral considers necessary to determine whether or not to accept your request;
8.2. where your request cannot be accommodated due to logistical reasons (e.g. time clashes, venue availability etc)
8.2.1. propose alternative times and Venues; or
8.2.2. reject your request.
8.3. reject your request if it does not, or you do not, comply with these terms and conditions;
8.4. reject your request if in the Cathedral’s opinion your request or proposed use of the Venue may or will:
8.4.1. cause or result in any activity that is objectionable, dangerous or unlawful;
8.4.2. be detrimental to the wellbeing of any person on or around the Cathedral’s ground or prejudice the Cathedral’s ability to foster the wellbeing of its staff;
8.4.3. infringe the intellectual property rights of any third parties;
8.4.4. breach any Cathedral Policy, Statute or By-Law;
8.4.5. be inconsistent with the Cathedral’s objects under the Constitution; or
9. If the Cathedral accepts your request you:
9.1. acknowledge that there will be costs associated with your use of the Venue, including but not limited to utilities, audio and visual, and cleaning;
9.2. will be required to execute a venue hire agreement in the form determined by the Cathedral from time to time to document the agreement between you and the Cathedral regarding your use of the Venue.
10. Where the hirer is a business or the venue hire is associated with a revenue raising activity, incorporated body or corporate function, the hirer shall take out and keep current a public liability insurance policy in the name of the hirer insuring the hirer for the minimum sum of twenty million dollars ($20,000,000) in respect of any negligent act or omission of the hirer in relation to any activities under the hire agreement.
11. The Cathedral has an ongoing public liability insurance policy that may be granted to ad hoc or occasional hirers for liability claims that arise due to acts of negligence. This is provided to uninsured individuals, non-commercial, non-revenue raising or private functions.
12. The hirer is responsible for insurance coverage of all their property equipment and goods that are used, left, or stored in our buildings. We accept no responsibility for loss, damage, or theft of anything owned by you, on loan to you or on deposit with you.
13. The hirer shall ensure that it is licensed or registered to carry out the activity authorised by the issuing of this hire agreement.
14. The hire agreement is not transferable.
15. The hirer shall comply with applicable laws and give all notices required by any legislation relating to an activity under the hire agreement.
16. No food or drink will be offered for sale by any hirer without the prior approval of the Cathedral.
17. Alcohol consumption will be prohibited without prior permission from Cathedral. Cathedral may require the hirer to provide a liquor licence and engage a licenced security officer for large events or if alcohol is being served.
18. No music system or amplified sound to be used by any hirer without the prior approval of the Cathedral.
19. Stalls and exhibitors’ sites must be approved by the Cathedral and no approved sites may be altered without the approval of the Cathedral.
20. The hirer is responsible for setting up and cleaning the venue and associated areas and shall ensure that the hire site or sites are left in a clean and tidy condition at the end of the hire.
21. The use of power by hirers shall not exceed that agreed to and approved by the Cathedral. Circuits are not to be overloaded.
22. All doors and windows are securely fastened, and lights shall be extinguished when leaving the venue.
23. In consideration of residents, the hirer is required to ensure that noise is always kept to a reasonable level including when entering or departing the venue.
24. The hirer is required to ensure compliance with the safe operating procedures provided and displayed on site for the operation of Cathedral’s equipment.
25. Access to the venue, including deliveries and contractors, is restricted to the hours stated on the hire agreement unless by prior arrangement and confirmation in writing from Cathedral. An inducted person for the hire must always be present whilst the venue is being accessed by you, your representatives, contractors, guests or attendees.
26. A hire agreement is liable to be revoked by Cathedral if the hirer fails to comply with a condition of the hire agreement or may be revoked in any other justifiable circumstance.
27. St Peter’s Cathedral reserves the right to change the Conditions of Hire and any agreements entered into regarding hire at any time.
28. Animals shall not be brought into the premises unless they are an accredited assistance dog, or otherwise approved by Cathedral.
29. The user/hirer must report to Cathedral all major/critical/serious incidents involving person on Cathedral property as soon as possible by phoning during office hours - (08) 8267 4551.
30. Keys will NOT be given to any temporary hirer. A caretaker with access to all sites of the Cathedral Grounds will be on site during your booking to assist. If you are requesting a long-term booking (3 months or longer), a key may be provided upon signing appropriate forms
31. Nails, screws or any other fastening devise are not to be driven in or attached in any way to the walls, floors, timberwork, ceilings, furniture, or fittings.
32. The emergency exits, and walkways must always be kept clear.
33. Repairing and/or replacing any damaged furniture, fixtures or fittings will be the responsibility of the permit holder.
34. A contractor or third-party participating organisation must take reasonable care for their own health and safety. They must ensure their acts do not negatively affect the health and safety of others.
35. Your booking of a Venue will only be effective once you have signed and returned the venue hire agreement to the Cathedral and paid any amounts as may be required under that agreement. Until you execute the venue hire agreement you do not have any right to use or access the Venue.
36. Cancellations made 28 days or more in advance of the booking date will receive a 100% refund. Cancellations made within 7 days will receive a 50% refund. Cancellations made within 48 hours will not receive a refund.
37. If there are any changes to the booking times made within a 48 hour period, an extra charge of $200 will be applied to your booking.
38. Your booking will only be made final upon receiving your deposit. If another hirer requests the same date and time as you and you have not paid your deposit, you will be given a notice to pay your deposit. If it is not paid in a timely manner, you will lose your booking.
